1. Introduction
Welcome to the official website of Âmago Audio. By accessing or using this site, you agree to be bound by these Terms and Conditions. Please read them carefully before using the website or purchasing our products directly or through authorized channels.
2. About Âmago Audio
Âmago Audio designs and manufactures high-precision microphones and audio products. Our products may be sold directly by Âmago Audio or through select authorized resellers and marketplaces. After-sales service, technical support, and warranty claims are handled directly by Âmago Audio or, where applicable, through an authorized reseller.
3. Use of Website
All content on this website, including text, graphics, product information, and downloadable materials, is owned by Âmago Audio or used under license, permission, or fair-use principles.
Some images, artworks, or photographs displayed on the site may be the property of their respective creators or licensors and are used solely for illustrative or informational purposes. Such materials remain the intellectual property of their original owners.
You may not reproduce, distribute, publicly display, or modify any part of this website without prior written consent from Âmago Audio or the relevant rights holder.
You agree not to use this website for any unlawful purpose, or in a way that could damage, disable, or impair the website’s operation, or interfere with other users’ access.
4. Purchases, Pricing & Fulfilment
Âmago Audio products may be purchased directly from Âmago Audio or through select authorized resellers and marketplaces.
For purchases made directly from Âmago Audio, Âmago Audio is the seller of record and is responsible for order processing, fulfilment, delivery, returns, refunds, and customer support in accordance with these Terms and applicable law.
For purchases made through an authorized reseller or marketplace where that third party is the seller of record, order processing, fulfilment, delivery, returns, refunds, and other transaction-related matters are governed by the terms and policies of that seller or platform. Such third parties operate independently of Âmago Audio, except where Âmago Audio itself is identified as the seller.
Warranty claims and technical inquiries relating to Âmago Audio products are handled directly by Âmago Audio or, where applicable, through an authorized reseller, as described in Section 6 (Limited Warranty & Service).
Product descriptions, specifications, images, pricing, packaging, documentation, and availability may be updated from time to time. Âmago Audio reserves the right to correct errors or inaccuracies and to modify product specifications, materials, packaging, documentation, pricing, or availability as part of ongoing product development and commercial operations. Such updates do not affect warranty coverage or statutory rights applicable to products already purchased.
5. Right of Withdrawal (EU Consumers)
Where required by applicable law, consumers purchasing products online or through other distance-selling methods have the right to withdraw from the purchase within 14 days without giving a reason, subject to any applicable legal exceptions.
For products purchased directly from Âmago Audio, the withdrawal period generally begins on the day the consumer, or a third party designated by the consumer other than the carrier, receives the product. To exercise the right of withdrawal, the consumer must notify Âmago Audio of the decision to withdraw within the applicable period.
For products purchased through an authorized reseller or marketplace where that third party is the seller of record, the right of withdrawal must be exercised through that seller or platform in accordance with its applicable return process and the requirements of applicable law.
Nothing in this section limits any statutory consumer rights available under applicable Portuguese or EU consumer protection law.
6. Limited Warranty & Service
Âmago Audio warrants that its products will be free from manufacturing defects in materials and workmanship under normal use for a period of three (3) years from the date of original purchase by the end user.
Customers who register their product on our website within 30 days of purchase will receive an extended warranty of five (5) years total coverage.
If a defect arises within the applicable warranty period, Âmago Audio will, at its discretion, repair or replace the product free of charge.
- Microphones: 3 years standard / up to 5 years with registration
- Accessories and adapters: 1 year (not eligible for extended coverage)
This warranty protects the mechanical and electronic functionality of the product as outlined in the applicable product specifications. Customers may be required to provide proof of purchase and the product serial number to validate a claim.
This warranty is transferable during the applicable warranty period. Any remaining warranty coverage follows the product and does not restart upon transfer. Proof of the original purchase and, where applicable, evidence of registration for the extended warranty may be required to validate a claim. Products originally purchased from unauthorized resellers are not covered by this Limited Warranty.
What the Warranty Does Not Cover
- Misuse, abuse, or accidents (e.g., dropping, crushing, or exposure to extreme conditions)
- Normal wear and tear or cosmetic damage not affecting performance
- Environmental damage (moisture, floods, water damage, extreme temperatures)
- Unauthorized modifications or repairs
- Damage caused by improper use or connection to incompatible devices
- Products with removed or altered serial numbers
- Routine inspection, calibration checks, performance verification, or preventative maintenance requested in the absence of a confirmed manufacturing defect
Warranty Service Procedure
- Register your product within 30 days of purchase to qualify for the extended 5-year coverage.
- Contact Âmago Audio or your authorized dealer with proof of purchase and a clear description of the issue.
- Wait for RMA approval before sending any item. Once approved, return the product in secure, well-padded packaging to prevent transit damage.
Shipping: Except where otherwise required by applicable law, shipping costs to send the product to Âmago Audio or an authorized service center are the customer’s responsibility. Return shipping for repaired or replaced items under a valid warranty claim will be covered by Âmago Audio.
Devices sent for repair will be thoroughly tested and serviced. Matched pairs or multi-channel kits will be recalibrated when required. Warranty-covered repairs are free of charge; out-of-warranty repairs will incur a service fee.
Warranty After Repair or Replacement
Products repaired or replaced under this Limited Warranty will remain covered for the remainder of the original applicable warranty period or for six (6) months from the date the repaired or replacement product is returned to the customer, whichever is longer.
A repair or replacement does not restart the original three (3)-year warranty or, where applicable, the extended five (5)-year warranty. Any replacement product will assume the remaining warranty status of the original product, subject to the six (6)-month minimum coverage period described above.
This policy does not limit any statutory rights or remedies that may apply under applicable consumer protection law.
Limitations and Exclusions
This warranty is exclusive and replaces any other express or implied warranties, including those of merchantability or fitness for a particular purpose. Âmago Audio is not liable for incidental, indirect, or consequential damages resulting from the use or inability to use the product. In no event shall Âmago Audio’s liability exceed the purchase price of the product.
This warranty does not limit your statutory consumer rights under applicable Portuguese or EU consumer protection laws.
Discontinued Products
Âmago Audio reserves the right to discontinue products. Owners of discontinued products remain entitled to service and repair support for the warranty duration following the last sale date. After this period, spare parts and service may become limited and subject to fees.
7. Returns & Repairs
For products purchased directly from Âmago Audio, returns, refunds, exchanges, and shipping-related matters are handled directly by Âmago Audio in accordance with these Terms and applicable law.
For products purchased through an authorized reseller or marketplace where that third party is the seller of record, returns, refunds, exchanges, and shipping-related matters are governed by the policies and procedures of that seller or platform, without prejudice to any statutory rights available under applicable law.
For warranty-related claims, repairs, or technical inquiries, customers should contact Âmago Audio directly at info@amagoaudio.com or, where applicable, through their authorized dealer.
Products must not be sent to Âmago Audio for warranty inspection or repair until an RMA or other return authorization has been provided. Products should be returned in secure, appropriately protective packaging to prevent damage during transit.
Except where otherwise required by applicable law, shipping costs to send a product to Âmago Audio or an authorized service center for inspection or repair are the customer’s responsibility. Return shipping for products repaired or replaced under a valid warranty claim will be covered by Âmago Audio.
8. Prototype / Loan Units (Studios & Testers)
All prototype or evaluation units provided by Âmago Audio remain the property of Âmago Audio. Recipients must handle them with care, use them solely for evaluation purposes, and may not resell, transfer, or disclose them. Units must be returned to Âmago Audio upon request. Any attempt to copy, reproduce, or derive the design, including reverse engineering, is strictly prohibited and may result in legal action under applicable intellectual property laws. Use of these units in public content does not constitute endorsement by Âmago Audio, the artist, or the studio unless explicitly agreed in writing.
9. Limitation of Liability
Âmago Audio is not liable for indirect, incidental, or consequential damages arising from the use or inability to use our products. Our total liability shall not exceed the original purchase price of the product.
10. Intellectual Property
“Âmago Audio,” the Âmago Audio logo, and “Rediscover your sound” are registered trademarks of Âmago Audio Unipessoal, Lda. All other trademarks, logos, product names, and brand identifiers appearing on this website are the property of Âmago Audio and are either in the process of registration or otherwise claimed as trademarks, and are not registered to any third party. All other third-party trademarks are the property of their respective owners.
All original content on this website — including the visual appearance of our products as displayed on this site, industrial designs, technical descriptions, text, schematics, graphics, and photography produced by Âmago Audio — is the property of Âmago Audio and protected under applicable intellectual property laws, including copyright, trademark, and design laws where applicable.
Certain images, media assets, or reference materials appearing on this website may be licensed from third-party sources or used with permission. Âmago Audio does not claim ownership over such third-party materials and acknowledges all rights held by their respective owners.
No part of this website may be reproduced, modified, distributed, transmitted, or publicly displayed without prior written consent from Âmago Audio or the relevant rights holder.
11. Changes to These Terms
Âmago Audio may update these Terms from time to time to reflect legal, technical, or business changes. Material updates will be posted on this website, and orders placed before a change will remain subject to the Terms in effect at that time.
12. Newsletter and Communications
By submitting your email address to subscribe to our newsletter, you agree to receive occasional updates, news, and product information from Âmago Audio.
Subscription is voluntary, and you may withdraw your consent at any time by sending an email to info@amagoaudio.com with the subject line “Unsubscribe.”
Your personal data will be processed in accordance with our Privacy Policy and will never be sold or shared with third parties.
13. The Founder’s Circle
Âmago Audio may offer a program called the “Founder’s Circle” to engage early supporters and enthusiasts of our products.
By submitting the Founder’s Circle application form, you agree to have your personal data collected and processed in accordance with Âmago Audio’s Privacy Policy.
Membership in the Founder’s Circle:
- Does not constitute a purchase, employment, or contractual obligation.
- Selectively grants access to early prototype feedback opportunities and direct communication with Âmago Audio.
- May include recognition or preferred financial conditions at Âmago Audio’s discretion.
- Requires that participants act responsibly and provide feedback in good faith; misuse may result in removal from the program.
Participants acknowledge that any feedback, suggestions, or ideas submitted to Âmago Audio in the Founder’s Circle may be used freely by Âmago Audio without restriction or compensation. All intellectual property rights in such submissions are assigned to Âmago Audio.
14. Mentions and Publicity disclaimer
Any references to artists, studios, performers, or educational institutions on this website or in our marketing materials are for factual illustrative purposes only. Such references do not imply endorsement, sponsorship, or affiliation by these individuals or organizations unless explicitly stated in writing. Âmago Audio makes no representations regarding the opinions, support, or approval of these entities.
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Portugal. Any disputes shall be submitted to the exclusive jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer protections in your country of residence.
